Wrongful death occurs when someone’s life is taken unexpectedly due to the negligent, wrongful act, or fault of another. North Carolina’s General Statutes require the surviving family members or the administrator of the estate to file their action within two years from the date of death which allow them to seek compensation from the at-fault parti(es).

Recently, Jetton & Meredith secured a six-figure settlement in the amount of $950,000.00 on behalf of the estate of a retired woman who was tragically killed in a collision with a commercial tractor-trailer on I-85 in Cleveland County, North Carolina.

The circumstances surrounding this accident are unique in that they involved heavy traffic and an active construction zone. This is particularly Important because these conditions require a heighten duty of care in the operation of their motor vehicle.

During our investigation, our firm and experts analyzed the black box data records of the tractor-trailer which revealed the tractor-trailer driver failed to adhere to his duties in operation of his trailer by driving at an excess speed, failing to keep a proper look out, failing to keep a proper distance, and negligently failing to brake until seconds before impact.

Furthermore, it was revealed that the driver was also operating his tractor-trailer with limited off time between shifts.

In September of 2024, Jetton & Meredith filed the lawsuit against the at-fault driver, leasing company and owner, and successfully resolved the case with all parties in less than a year, which in retrospect, brings some closure to a family who continues to grief their great loss.

Contacting a Wrongful Death Attorney be a good step forward towards accountability.
