Protecting Your Rights to Help You Get the Benefits You Deserve
In general, if you are hurt at work or during the course of performing work-related duties, you should be eligible to collect workers’ compensation.
However, there are certain steps that every injured worker should take to help their compensation claim proceed through the system as smoothly as possible, including:
- Informing your employer: Assuming your injury is not severe enough to require immediate medical attention, the first thing you should do following a workplace accident is to inform your employer. Your injury must be reported within a certain amount of time – otherwise, you run the risk of losing out on benefits to which you may have otherwise been entitled.
- Report your injury in writing: While a verbal notice of your injury should be enough, you should also report your injury in writing and keep a copy for your records. That way, if your employer fails to fill out the required paperwork with the North Carolina Industrial Commission or denies that your injury is work-related, you have some evidence to help back up your claim.
- Seek medical attention: After you have reported your injury to your employer, you should seek medical attention as soon as possible. You may visit any medical provider of your choosing. However, if your employer provides you with a list of approved doctors, you should consider visiting one of them in addition to getting an outside opinion.
- Gather all documentation related to the accident: It is important to collect all of the documentation related to your accident and any follow-up care, including medical records and records of treatment. If there were witnesses to your accident, it is also helpful to gather their accounts of what happened.
- Seek legal help: The process of applying for workers’ comp benefits can be complicated and it is not uncommon for an employer to deny initial claims. Our Charlotte injury attorneys have extensive experience handling these claims and we can help guide you through the claims process.
