How long does it take to get divorced in North Carolina?

North Carolina requires spouses to live separately and apart for one year before filing for an absolute divorce. At least one spouse must have lived in the state for six months prior to filing. Once you file, your spouse has 30 days to respond. Beyond the separation period, how long the rest of the divorce process takes will depend on whether you and your spouse agree on major issues like property division and spousal support.

Is North Carolina a 50/50 divorce state?

No. North Carolina follows equitable distribution, meaning marital property and debt are divided fairly, not necessarily equally. Factors such as each spouse's income, the length of the marriage, and whether either spouse wasted marital assets can shift how a court divides property.

What if my spouse won't agree to the divorce?

North Carolina is a strict no-fault divorce state, meaning your spouse cannot block the divorce by refusing to sign papers or agree to ending the marriage. Refusal to cooperate can complicate the process, particularly around custody or property division, but it doesn't prevent the divorce.

Can I get a protective order if I'm not divorced yet?

Yes. A domestic violence protective order (50B) is available regardless of whether divorce proceedings have started, and it can address immediate safety concerns, including temporary custody and housing arrangements, while your broader case proceeds.

How is child custody decided in Union County?

North Carolina courts decide custody based on the best interests of the child, weighing factors like each parent's living situation, the child's relationship with each parent, and any history of domestic violence or substance abuse. Union County judges apply the same statutory standard as the rest of the state, but local practices around parenting coordinators and custody evaluations can vary by courthouse.

Do grandparents have custody or visitation rights in North Carolina?

Grandparent rights in North Carolina are limited and generally only available when there's an existing custody case between the parents, or when specific circumstances, like a parent's unfitness, apply.
