Understanding Legal & Physical Custody in North Carolina

Physical custody determines where your child lives day to day. Legal custody determines who has authority to make the major decisions in your child's life; things like which school they attend, what medical treatment they receive, and how they're raised religiously.

Parents often assume these two move together, but a parent without primary physical custody can still hold equal legal custody, meaning your say in major decisions doesn't disappear just because your child spends most nights at the other parent's home.

Courts award custody based on what serves your child's best interests; this standard considers each parent's role in the child's daily life, the stability each household offers, and, in some circumstances, the child's own preferences as they get older.

There's no default assumption that favors one parent over the other based on gender or income alone.

What to Do When the Other Parent Won't Follow the Order

Enforcement generally starts with a motion for contempt, asking the court to hold the violating parent accountable for failing to comply with a valid order. Courts take these violations seriously, particularly when a pattern develops.

Custody Modifications

North Carolina allows a modification when a parent can show a substantial change in circumstances affecting the child since the last order was entered; a job relocation, a change in the child's needs, a parent's remarriage, or a shift in either household's stability can all qualify, depending on how directly the change affects your child's welfare.

What typically doesn't qualify is simply wanting a different arrangement because circumstances feel unfair now. The substantial change standard exists to keep custody orders stable for children.
