Will I have to sell my house in the divorce? 

Not necessarily. Courts can award the home to one spouse while offsetting the other spouse's share with different assets, or the home can be sold and the proceeds divided. The decision will depend on whether either spouse can afford to refinance the mortgage alone and whether keeping the home serves your children's best interests.

Will I Get to Keep What's Mine?

North Carolina divides marital property under equitable distribution, which means fair, not automatically equal. Your home, retirement accounts, investment portfolios, and even a business you started during the marriage typically count as marital property subject to division, while assets you owned before the marriage or received as a personal gift or inheritance often stay separate, provided they were kept separate.

How is a family business handled in a divorce in Union County?

A business started or grown during the marriage is typically treated as marital property, even if only one spouse actively ran it. This typically means a business valuation, and the non-operating spouse may be entitled to a share of its value without taking an ownership stake.

Can I lose custody if I move for a job?

A job relocation doesn't automatically change your existing custody agreement, but a proposed move that would take your children away from their other parent can become a contested issue. Courts weigh the reason for the move against the disruption to the children's existing relationships and routine.

Does adultery affect a divorce in North Carolina?

Marital misconduct generally does not affect property division unless it resulted in the financial waste or dissipation of marital assets. However, adultery committed prior to separation strictly governs alimony under North Carolina law: 

  • If the dependent spouse committed adultery, the court must deny alimony (unless condoned by the other spouse). 
  • If the supporting spouse committed adultery, the court must award alimony. 
  • If both spouses committed adultery, the court has discretion to grant or deny alimony. 

What happens to retirement accounts in a divorce?

Retirement accounts earned during the marriage are typically marital property, divided through a court order called a Qualified Domestic Relations Order for accounts like 401(k)s and pensions. The share you're entitled to usually reflects only the portion earned during the marriage.
