Charlotte Theft Crimes Attorney
What is the Difference Between Theft and Larceny?
Theft and larceny are typically used interchangeably, but larceny is largely seen as a lesser form of theft. However, in North Carolina the legal term for taking personal property from another without consent and with no intention of returning it is only defined as larceny not theft.
If the fair market value of the property is worth less than $1,000, it is a Class 1 misdemeanor under North Carolina law. Being convicted of larceny can carry a jail sentence of up to four months. At Jetton & Meredith, our lawyers have the skills, resources, and knowledge to aggressively pursue an outcome that protects your interests and allows you to move past this difficult time in your life.
What is Felony Larceny in North Carolina?
Larceny is charged as a felony if the property is worth more than $1,000 or if the property taken was an explosive, firearm, or record of paper in the State Archives of North Carolina. Larceny can also be charged as a felony if the property was taken directly from the person or committed during a burglary. If convicted of larceny, you may face anywhere from four to eight months in jail.
