Military Members’ Rights Regarding Divorce
The Soldiers’ and Sailors’ Civil Relief Act, 50 USC Section 521 is designated to protect members of the military from having divorce actions forced on them while they are on active duty. This law allows divorce proceedings to be postponed for the term of active duty and 60 days after the military member has returned from deployment. A service member in the U.S. Army, Navy, Air Force, or Marines may waive this right if they wish.
Resolving Complex Military Divorce Issues
In addition to the logistics of filing for divorce during active duty deployment, there are other unique issues that affect members of the military going through a divorce. For example, child custody and visitation are more complex when one parent is on active duty.
Our Charlotte military divorce attorneys help resolve issues such as:
- Equitable division, including military pension division
- Modifying custody and visitation schedules when military members return from deployment
- Veterans’ benefits, including medical care and disability benefits
We caution military service member and their spouses against engaging in the divorce process without first speaking with a lawyer. Our attorneys can advise you on all aspects of divorce and the unique complexities of military divorce.
