What Your North Carolina Separation Agreement Can Address
Spouses can use an agreement to set private terms for many issues arising from their separation. The appropriate provisions depend on the family’s finances, property, support needs, and parenting circumstances.
Common subjects addressed in an agreement include:
- Marital property and debts: Allocation of real estate, vehicles, personal property, accounts, loans, and credit card balances.
- The marital home: Use of the residence, payment of related expenses, and possible sale or transfer terms.
- Financial support: Temporary post-separation support and longer-term alimony.
- Child custody: Parenting schedules, decision-making responsibilities, and arrangements for exchanges.
- Child support: Payment responsibilities and treatment of certain child-related expenses.
- Agreement obligations: Deadlines, required actions, and consequences if either spouse doesn’t follow the terms.
Child custody and child support provisions require particular care. A court can generally review these issues based on a child’s best interests and reasonable needs, even if the parents previously agreed on terms.
Does a Separation Agreement have to be notarized in North Carolina?
A written agreement isn’t required for spouses to become separated in North Carolina. Generally, spouses are considered separated when they live in different homes and at least one intends the separation to be permanent.
To be valid under North Carolina law, a separation agreement must be in writing and acknowledged by both spouses before a qualifying certifying officer, often a notary public. Unless incorporated into a court order, the signed agreement remains a private contract rather than a court judgment.
Separation Before an Absolute Divorce
North Carolina generally requires spouses to live separately for at least one year before either spouse can file for an absolute divorce, which legally ends the marriage. One spouse generally must also have lived in North Carolina for at least six months before filing.
Timing matters because entry of the divorce judgment can affect certain claims. Claims involving equitable distribution, the court process for dividing marital property and debts, and alimony generally must be preserved before an absolute divorce is entered. Seeking legal advice before signing an agreement or filing for divorce can help identify rights that the proposed language doesn’t address.
Drafting, Reviewing, & Negotiating Terms Around Your Priorities
Our Charlotte separation agreement attorneys evaluate proposed terms in light of your financial position, parenting responsibilities, support concerns, and possible divorce. We tailor our work to your circumstances instead of treating the agreement as a standard form.
Our representation can include:
- Drafting an agreement: Preparing language that addresses the issues you want to resolve and identifies matters that remain open.
- Reviewing proposed terms: Analyzing an agreement prepared by your spouse or your spouse’s attorney before you sign.
- Negotiating disputed provisions: Addressing property, support, parenting, and other terms when the parties begin from different positions.
- Coordinating related issues: Considering child custody, child support, post-separation support, alimony, equitable distribution, and future divorce proceedings.
Detailed financial provisions may be especially important when the marital estate includes a business, retirement benefits, investment accounts, executive compensation, or multiple real estate holdings. We examine how the proposed language treats each asset and obligation rather than assuming that silence preserves your position.
