Assault on a Female

Assault on a Female Charge in Charlotte

Focused Criminal Defense for a Distinct North Carolina Misdemeanor

Assault on a female isn’t simply a generic assault charge with a different label. Under NCGS 14-33(c)(2), it carries its own elements, its own penalty tier, and procedural consequences that don’t apply to ordinary simple assault. At Jetton & Meredith, PLLC, our criminal defense attorneys handle this specific charge for clients throughout Charlotte and Mecklenburg County.

If you or someone you know is facing an assault on a female charge, contact our office now at (704) 931-5535. We’re available evenings and weekends, including at the jail.

What NCGS 14-33(c)(2) Actually Requires

The statute applies when a male who is at least 18 years old commits an assault, assault and battery, or affray against a female, provided no other law imposes a greater punishment. That age-and-sex element is what separates this charge from the Class 2 misdemeanor that a charge under NCGS 14-33(a) would produce. The distinction matters because Class A1 is the most serious misdemeanor level in North Carolina, with meaningfully different sentencing exposure.

Physical contact isn’t a required element. Under common law assault principles, a threat or an attempt coupled with the present ability to cause immediate harm can be enough for a conviction, even if no injury occurred.

Penalties & Sentencing Under Structured Sentencing

North Carolina’s misdemeanor structured sentencing chart assigns every Class A1 conviction to one of three punishment tracks: active (jail), intermediate (supervised probation with possible jail), or community (unsupervised probation or fines). Which track applies depends on your prior record level. The maximum active sentence for this charge is 150 days in custody. That ceiling can shift upward if prosecutors pursue a separate felony statute, which is possible when the conduct causes serious bodily injury or involves strangulation.

Domestic Violence Overlap: Bond, Protective Orders, & Parallel Proceedings

Assault on a female applies regardless of whether the parties have a personal relationship. When they do, a separate layer of rules activates. North Carolina’s domestic violence pretrial release statutes require a judge, not a magistrate, to set bond and any release conditions. Under NCGS 15A-534.1, a defendant can be held up to 48 hours after arrest until a judge becomes available to make that determination.

The same conduct can also give rise to a civil Domestic Violence Protective Order under Chapter 50B when a qualifying relationship exists. When no such relationship exists, a civil No-Contact Order under Chapter 50C may be available, but only if the conduct amounts to stalking or nonconsensual sexual conduct as defined under that chapter. These are separate proceedings: the criminal case is the State versus the defendant, while a 50B or 50C order is a civil action the alleged victim brings independently. Resolving the criminal charge doesn’t automatically resolve any civil order, and vice versa.

Defenses Available to This Charge

Because assault on a female rests on a common law foundation, the recognized common law defenses apply directly. Self-defense and defense of others are the most frequently raised. Consent can be a defense in certain factual contexts. False accusations and insufficient evidence on any single element are also viable avenues because the State must prove every element beyond a reasonable doubt. A gap in the evidence on age, sex, or the act itself can defeat the charge entirely.

One point clients often misunderstand: only the prosecutor or a judge can dismiss a criminal charge. The alleged victim can’t unilaterally drop it. Their cooperation can influence how the prosecution proceeds, but the charging decision belongs to the State.

How These Charges Arise in Mecklenburg County

Most assault on a female charges originate one of two ways. An officer responds to a reported incident, forms probable cause at the scene, and charges the accused directly. Alternatively, a private citizen applies for a criminal complaint and warrant through the magistrate’s office. Both paths lead to the criminal department at the Mecklenburg County Courthouse, part of North Carolina’s 26th Judicial District, where the case moves through first appearances, arraignment, and either a plea or trial.

Knowing how the charge entered the system matters for strategy. An officer-initiated charge typically means law enforcement documentation, body camera footage, and a 911 call are in play. A private-citizen warrant means different evidence and a different procedural posture from the outset.
