Strangulation

Assault by Strangulation Lawyer in Charlotte

Felony Defense for Strangulation Charges in Mecklenburg County & Beyond

An assault by strangulation charge in North Carolina is a Class H felony from the moment it’s filed, not a misdemeanor that escalated. That distinction matters immediately: at the bond hearing, in plea negotiations, and at trial. At Jetton & Meredith, PLLC, we represent clients facing this charge throughout Charlotte and the surrounding counties, and we handle the criminal case alongside any related protective order proceeding so you don’t have to coordinate separate legal teams.

If you’ve been charged with assault by strangulation in Charlotte or the surrounding Mecklenburg, Cabarrus, Union, Iredell, or Gaston counties, call Jetton & Meredith, PLLC at (704) 931-5535 to discuss your situation. Evening and weekend consultations are available.

How North Carolina Law Defines Assault by Strangulation

Under N.C.G.S. § 14-32.4, assault by strangulation is a Class H felony. A simple assault, by contrast, is a Class 2 misdemeanor carrying a maximum of 60 days in jail. Strangulation doesn’t enhance a misdemeanor after the fact. It creates an entirely separate felony charge with a different sentencing range and a permanent record that can’t be expunged under current North Carolina law.

The charge reflects a medical and legal reality: applying pressure to the neck can cut off oxygen or blood flow to the brain and cause unconsciousness or death even when it leaves no visible marks. Courts and prosecutors may treat the absence of visible injury as a reason to look harder for other evidence, not as a reason to dismiss.

What the State Must Prove at Trial

The statute doesn’t define “strangulation” or “physical injury,” so North Carolina courts have developed those definitions through case law. To secure a conviction, the State must establish three elements:

  • An assault occurred against another person
  • The assault involved strangulation, meaning pressure was applied to the neck or throat in a way that impeded normal breathing or blood circulation
  • Physical injury resulted, which courts have interpreted broadly to include bruising, abrasions, a raspy voice, or difficulty breathing

A complete interruption of breathing isn’t required. North Carolina courts have upheld convictions where the evidence showed only that pressure on the throat caused difficulty breathing, and loss of consciousness isn’t a required element either. The evidentiary threshold is lower than many defendants expect, which is why understanding the case law early matters.

Felony Penalties & How the Charge Can Escalate

North Carolina uses a structured sentencing system that sets punishment based on two variables: the offense class and the defendant’s prior record level. For a Class H felony, sentences generally range from 4 to 25 months, with a statutory ceiling of up to 39 months depending on prior record level and aggravating factors. If the strangulation results in serious bodily injury, such as a substantial risk of death, permanent disfigurement, or prolonged hospitalization, the charge can elevate to a Class F felony carrying a longer potential prison term. Beyond incarceration, a felony conviction can create a permanent record that can affect employment, housing eligibility, and firearm rights.

Assault by Strangulation in Domestic Violence Cases

Strangulation charges most commonly arise in domestic violence contexts, and they rarely arrive alone. A defendant may face the criminal charge in Mecklenburg County court while simultaneously being served with a Domestic Violence Protective Order under Chapter 50B (governing people with a personal relationship) or a no-contact order under Chapter 50C. Those civil proceedings run on their own timeline and can require vacating a shared residence and restricting all contact with the alleged victim before the criminal case is resolved.

Prosecutors and judges often treat strangulation allegations with heightened seriousness at bond hearings because of the recognized lethality risk these situations carry. Effective December 1, 2025, North Carolina law also permits warrantless arrests based on probable cause for the misdemeanor crime of domestic violence and requires a judge to set pretrial release conditions for defendants charged with that offense. We represent clients in both the criminal proceeding and the related 50B or 50C matter, coordinating strategy across both rather than treating them as separate problems.

Potential Defenses to an Assault by Strangulation Charge

Every case turns on its own facts, but several defenses commonly arise:

  • Self-defense or defense of others, where the contact was a reasonable response to a threat
  • Accident, where contact with the neck was unintentional and lacked the intent required for an assault
  • Insufficient strangulation element, where incidental contact with the neck didn’t close the airway or restrict blood circulation
  • Victim recantation, which is common in domestic settings and can significantly affect the State’s evidence
  • Constitutional challenges, including suppression of evidence obtained through an improper search or seizure

North Carolina courts also recognize mutual combat in limited circumstances where both parties voluntarily agreed to fight, though this generally limits rather than establishes a self-defense claim. We evaluate all of these angles at the start of your case, not after the State has had time to build its file.
