What North Carolina Law Defines as Stalking
Under N.C. Gen. Stat. §14-277.3A, stalking requires willful conduct, on more than one occasion, that causes a reasonable person to fear for their safety or suffer substantial emotional distress. That reasonable person standard is evaluated from the perspective of someone in the alleged victim’s circumstances, which matters significantly in how a case is built and challenged.
The statute targets two types of behavior. First, “harassment”: knowing conduct, including written, electronic, or telephonic communication, directed at a specific person that torments or terrorizes them with no legitimate purpose. Second, a “course of conduct”: two or more acts through which the accused is in the presence of, follows, monitors, observes, threatens, or communicates to or about another person, directly or through third parties. A single incident, no matter how alarming the alleged victim found it, doesn’t satisfy this threshold.
Misdemeanor to Felony: How North Carolina Classifies Stalking Penalties
North Carolina classifies a first stalking offense as a Class A1 misdemeanor, punishable by up to 150 days in jail plus fines or restitution. Courts imposing community punishment on a Class A1 stalking conviction are required to add supervised probation on top of any other sentence.
Two circumstances elevate the charge to a felony:
- Prior stalking conviction: A second offense becomes a Class F felony, regardless of how much time has passed since the first.
- Active protective order: Stalking committed while a court order prohibiting that conduct against the same victim is in effect is a Class H felony.
That second escalation path is why the protective order component of your case matters from day one.
How Protective Orders Intersect with Stalking Charges in Charlotte
North Carolina recognizes two civil orders that frequently appear alongside stalking allegations. A 50B domestic violence protective order applies when the parties share a qualifying personal relationship, such as spouses, former partners, or household members. A 50C civil no-contact order is available to stalking victims who don’t have that kind of qualifying personal relationship with the accused, covering situations involving coworkers, neighbors, acquaintances, or strangers where a 50B order wouldn’t apply. Violating either order while continuing the conduct that prompted it can turn a misdemeanor into a Class H felony.
Our attorneys work on both sides of these orders. When a 50B protective order has been entered without specific findings on the underlying domestic violence complaint, it may be vulnerable to challenge under the North Carolina Court of Appeals decision in Kenton v. Kenton. An order set aside on those grounds is unenforceable, which means a criminal charge that depends on violating that order can lose its footing. That kind of coordinated strategy, connecting the criminal defense to the civil order, is something we’re positioned to pursue because our criminal defense and family law teams work the same cases together. Stalking matters in Charlotte are prosecuted through the Mecklenburg County court system, and our attorneys know how those proceedings unfold.
Challenging a Stalking Accusation in North Carolina
Every stalking case rests on facts the prosecution must prove. That means there are facts they can fail to prove. Common defense approaches include:
- Contesting the course of conduct: If the alleged incidents don’t add up to two or more qualifying acts, the statutory threshold isn’t met.
- Establishing legitimate purpose: The statute applies only to conduct undertaken without legal purpose. Contact made in connection with a custody matter, a business obligation, or another lawful reason may fall outside its reach.
- Challenging the reasonableness of fear: Courts apply an objective standard. If the alleged victim’s fear wasn’t one a reasonable person in their circumstances would share, that element of the charge breaks down.
- Questioning the evidence: Cyberstalking cases depend heavily on electronic communications. Whether that evidence was lawfully obtained and whether it can be attributed to your device or account are questions worth pressing.
