First Offense DUI

First Offense DWI Attorney in Charlotte

Protect Your Defense & Driver’s License After a First DWI Arrest

A first impaired-driving arrest can trigger two separate legal processes: a criminal case and an administrative action affecting your driver’s license. An arrest, a civil license revocation, and a conviction aren’t the same event. Each may carry different deadlines and consequences. We review both sides of the case so you can make informed decisions from the beginning. We examine the traffic stop, field sobriety tests, chemical testing, arrest procedures, and available recordings. We also consider how the charge may affect your transportation and employment. Your options depend on the evidence, your driving history, and any aggravating or mitigating circumstances.

Call (704) 931-5535 to discuss your first DWI charge with our criminal defense attorneys.

How North Carolina Defines a First-Offense DWI

North Carolina generally uses the term driving while impaired, or DWI, although many people search for DUI representation. Under N.C.G.S. § 20-138.1, impaired driving includes operating a vehicle while under the influence of an impairing substance or after consuming enough alcohol to reach an alcohol concentration of 0.08 or higher at a relevant time. The statute also covers driving with any amount of a Schedule I controlled substance or its metabolites in the blood or urine.

Driving while impaired is a misdemeanor, but the words “first offense” don’t determine the sentence. The prosecution’s evidence, statutory sentencing factors, prior driving history, and court findings all matter. We need to assess the specific facts before explaining the potential paths forward.

What Can Affect Sentencing in a First DWI Case?

After a DWI conviction, North Carolina courts conduct a sentencing hearing and weigh grossly aggravating, aggravating, and mitigating factors. Those factors determine the applicable punishment level, which can affect the possible combination of jail, fines, probation, community service, substance use assessment, treatment, and other conditions.

Factors that may affect sentencing include:

  • Prior record: Certain previous impaired-driving convictions and driving offenses may affect the court’s analysis.
  • Alcohol concentration: The reported concentration and related testing evidence may be relevant.
  • Passenger circumstances: Having a child or a person with a qualifying disability in the vehicle can carry significant legal consequences.
  • Injury allegations: Serious injury connected to impaired driving may qualify as a grossly aggravating factor.
  • Mitigating circumstances: Safe and lawful driving, driving history, and other statutory facts may support mitigation.

Two people without prior DWI convictions may face different sentencing levels. We separate challenges to the State’s evidence from mitigation that may become relevant if there’s a conviction.

Driver’s License Consequences Can Begin Before Court

A civil license revocation may begin before the criminal charge is resolved. This administrative consequence is separate from any revocation resulting from a later conviction, so license deadlines and criminal court dates may require attention at different times.

A limited driving privilege may allow an eligible driver to operate a vehicle for approved purposes during certain revocation periods. Eligibility isn’t automatic. It depends on the basis for the revocation, statutory conditions, timing, and supporting documentation. Ignition interlock requirements may also apply in circumstances identified by North Carolina law, including certain alcohol-concentration or prior-conviction situations.

Evidence We Review When Building a DWI Defense

A defense strategy should come from the complete record, not assumptions about a first charge. We assess whether the officer had a lawful basis for the stop, what the officer reported observing, and whether video or witness accounts support or conflict with the written reports.

Our case review may include:

  • The stated reason for the traffic stop or checkpoint detention
  • Body-camera, dashboard-camera, or other available video
  • The instructions and administration of field sobriety tests
  • Breath, blood, or urine chemical-testing procedures
  • Officer observations and witness accounts
  • Citations, revocation documents, and arrest reports

We assess whether the State can prove each required element and identify issues that may affect admissibility, negotiations, trial decisions, or sentencing. Founding partner Mark S. Jetton, Jr. represents people charged with DWI, misdemeanors, felonies, and traffic offenses. He is also a member of the National College for DUI Defense.
